Show me the evidence

In a case orchestrated by NSW police and then Senior Crown Prosecutor Mark Tedeschi AM KC,  Robert Xie was convicted of murdering five members of his wife’s family, the Lins. Andrew L. Urban’s new book demolishes this wrongful conviction. 

Robert Xie’s alibi was supported by his wife, Kathy. It was a serious challenge to the prosecution’s case.

The following exchange took place with the jury absent (during the defence closing by Robert Webb appearing for Xie) –

WEBB: So if it may be submitted, your Honour, would your Honour permit and – would it be permissible for your Honour to say to the jury “if you thought in respect of the evidence of Kathy Lin that there was a reasonable possibility that Kathy Lin was not mistaken and gave honest evidence, that you’d be duty bound to acquit”?

HER HONOUR: I’m not sure that I’d go that far, Mr Webb.

Webb is asking the judge to outline a reason for the jury to entertain reasonable doubt, but Her Honour thinks that’s “going too far”…

    Andrew . This is just another revolting piece of work from that scurrilous prosecution camp. The team that does over the innocent . Shouting at innocent Kathy Lin like the drivers dog – with the judges approval.
    As we know, the police Prosecuting system was fully involved in the framing of innocent Tim Anderson and his Tedeschismistic conviction for the Bombing of the Hilton.
    Just add Robert Xie to that now long list.
    Thank God that particular prosecutor is gone – but not forgotten. Problem is they seem to breed like rabbits !
    Australian courts are full of them – Sue Neill-Fraser,the Chamberlains,Ray Bailey,Derrick Bromley, Darryl Beamish and together with the use of flexible forensics Manock and friends. There doesn’t seem to be any regard for the seeking (pursuit) of “justice”- that’s not part of the game plan .
