Will High Court grant Derek Bromley special leave to appeal?

The decision on Derek Bromley’s application seeking leave to appeal to the High Court will be announced on Wednesday, December 13, 2023, seven months after it was put before the court. 

The official summary of the judgment will be posted on the High Court website by Wednesday evening and the full judgment shortly after.

This comes five years since the South Australian Court of Criminal Appeal refused Derek Bromley leave to appeal his 1984 murder conviction. Bromley, has now served 39 years in prison and “throughout that time the state knew that the conviction had been obtained through evidence which was false and misleading insofar as the status of the chief Crown witness was concerned,” according to Dr Bob Moles, Flinders University legal academic.

    Any conviction based on evidence PROVEN false & misleading is an egregious failure of the justice system, & a denial of Mr Brinkley’s human rights.

    7 months just to confirm leave to appeal. Yet SNF was shunted in 45mins!

    Blimey, I hope these Judges haven’t spent all this time carefully bricking Derek in.

    I remain hopeful that this shameful situation is finally corrected for Derek!!
